Privacy and Cookie Policy
IXXI Concepts B.V., located at Oranjesingel 73, 6511 NR Nijmegen, the Netherlands, operating under the name of IXXI (“IXXI”, “we”, “us” or “our”), respects the privacy of visitors to and users of our website www.ixxi.com (“Website” and “Creation Module”), and the privacy of our customers placing an order through our Website. This policy clearly explains what information we collect in the context of the use of our Website and about you as a visitor to our Website and as a customer and how we use and protect this information. IXXI is responsible for the processing of your data as controller.
1. Applicability
This Privacy and Cookie policy (“Policy”) applies to each Website, website visit, transaction and each agreement entered into through the Website. All information we collect about you, including your personal data, when you visit and/or use our Website will be treated in accordance with this Policy and the purposes, principles and bases described in this Policy. This Policy does not apply to third party websites linking to or linked to on our Website.
2. Data collected by us
IXXI enables you to create your own personalized photo-based wall decoration on line and to have your order delivered to the address of your choice. In performing our services we can collect your data in two ways:
Data provided by you
IXXI collects data provided by you, such as your email address and password when you register as a new customer and create an account using the Creation Module. You can also create an account yourself on the Website. In that case we ask you to fill in your first name, surname, email address and a password. By logging into your account you can also add and update your data. You can enter your postal address, telephone number and email address, which will enable you to place future orders more quickly. You can also indicate how you heard about IXXI. We also collect your order information, such as your name, delivery and invoice address, telephone number and payment information when you place an order with us (and, if the order is sent to someone else, the name and address of the recipient of the order), as well as the files, such as the photos you upload and/or use on our products. We use your email address to send you the order confirmation and tracking information for your order. Your telephone number will be used only if we need to contact you, for example if your order cannot be delivered or if the delivery driver cannot find your address. We also collect personal data if you participate in a prize contest organized by us or if you give us your opinion, for example by writing a review about IXXI or an IXXI product. We will store your email address if you create an account, but we may also store your email address separately if you sign up for our newsletter on the Website.
Data automatically collected by us
IXXI also collects data we receive on the basis of your use of our services such as the IXXI Creation Module which you can use to create your personalized wall decoration, your visit to our Website and any other websites that may be accessed from our Website. For example, we collect your IP address and the browser used by you as well as the pages you visit, the date and time of your visit or use and how you use our Website or Creation Module. We do this to enhance user experience and customer service on the Website.
3. How do we use your data?
Your data may be used for the following purposes:
Acceptance, processing and execution of your order
Your data are used to process, execute, produce and deliver your order to the address of your choice. We will also use your data to inform you of the status of your order. We transfer your data to other companies engaged by us to perform specific services. Examples include third parties engaged by us for the production of your order, delivery services such as PostNL and FedEx for sending and delivering your order, online payment service providers such as IDEAL, Klarna or PayPal for processing your credit card or other payments, service providers for sending our emails or other types of customer communication, marketing research companies for analysing our data or removing duplicate records from our database, and our customer service. The IXXIs created are stored for 3 months in case something goes wrong and we want to print the IXXI again as a service to the customer.
Managing your account
You can create your own account on our Website. The data stored in your account include your name, delivery and invoice address, telephone number and email address. If you create an IXXI and save it in your account, we will store it for 45 days to enable you to view, change and order your IXXI.
We also store your order history to enable you to retrieve your products quickly and to view and share your orders or to place repeat orders.
Direct marketing, co-branded offers and newsletters
If you have placed an order with us, we may use your data for direct marketing purposes to send you commercial information or offers about our products and services via email, direct mail or other means of communication. This information and these offers may also be compiled in a ‘co-branded’ way in collaboration with a partner or a company associated with us, in which case it will relate to products or services of such third party.
You can register for our newsletter, which is sent by email or direct mail, to receive special offers and information about new or additional products and services. If you no longer wish to receive commercial information such as our newsletter, you can always let us know by contacting our customer service. If you want to opt out of receiving our commercial emails, you can click the unsubscribe link at the bottom of the email.
Reviews and comments
We welcome your feedback on your experience with our Website and our products. We use the services of third parties such as TrustPilot to collect reviews from our customers about IXXI products. If you write a review about an IXXI product, TrustPilot will collect personal data concerning you. More information about the personal data collected by TrustPilot and how TrustPilot uses them can be found on: http://nl.legal.TrustPilot.com/end-user-privacy-terms.
If you leave us a review, for example through a third party such as TrustPilot, social media or our customer service, we may use that review (or part of it) for any purpose, provided that we will not use your review in combination with your name or other personal data. We will use your review (or part of it) in combination with your name (or other personal data) provided to us by you only with your prior and explicit permission.
Promotional activities and prize contests
If you participate in promotional activities or a prize contest, we will ask you for your name, address, telephone number or email address, and it could be that you share other materials, such as your photos. These data enable us to carry out the promotional activities or conduct the prize contest, to inform the prize winners that they have won, and to publish the names of the prize winners (after obtaining their permission) on our Website, in our newsletter and/or on social media.
Maintenance, statistical analysis and improvement of our services
We are committed to ongoing improvement of our services. We use third-party analytics software for that purpose, namely Google Analytics and Hotjar. This analytics software places cookies that enable us to collect general visitor information and to generate reports on the use of our services. The data we register via the Website for that purpose include the language settings of your browser, the date and time of your visit or use, what products you view and design and what Creation Module functionalities you use.
We may also use your data to ask you to participate, without obligation, in a customer or market survey. Sometimes we engage other companies to conduct such a survey. In that case we provide your email address or telephone number to such companies, which must, of course, also comply with this Policy!
Fraud
We use our customer data to identify, prevent and combat fraud. We have a legitimate interest in doing so. If we are requested to provide access to personal data on the basis of a legal obligation, for example in the context of a criminal investigation, we will comply with such a request and provide the requested data to the (investigating) authority in question.
Improvement of our customer service
To be able to assist you quickly if you have any questions, our customer service may use your data such as your name and your order number. Our customer service may take notes during the conversation to register why you contacted us and which solution we provided. We also store such data in relation to our customer service. This is useful if you contact us again at a later date. If you contact our customer service by email, social media or live chat, we may also record and store the conversation or chat for quality monitoring and training purposes. This enables us to analyse and improve our customer service.
If the processing of your data is based on your permission only, you may revoke such permission at any time. We will then stop such processing immediately.
We will not retain your data for longer than is necessary for the purposes outlined above, unless we are under a legal obligation to retain the data. Accordingly, the retention period may vary depending on the type of personal data and the purposes for which they are retained.
4. Transfer to third parties
IXXI may also engage third parties for the purposes outlined above, in which case your personal data may be processed as part of your other data. We will make your data available to third parties only in the manner set out above, and only for purposes described in or compatible with this Policy.
These partners or service providers engaged by us, or any other type of (sub)processor engaged by them, in turn, may be established in countries outside the European Union, and your data may consequently be transferred to countries outside the European Union. Such a transfer is permitted if the country concerned provides an adequate level of protection as determined in an adequacy decision adopted by the European Commission. In case of a transfer to a country that does not provide an adequate level of protection, IXXI will transfer the data only if the recipient agrees to provide appropriate safeguards, for example by complying with the EU standard contractual clauses for the transfer of personal data included in the European Commission Decision of 5 February 2010 (2010/87/EU) or, in case of a company established in the United States of America, applies the principles of the EU-US Privacy Shield.
5. Protection of your data
IXXI treats your data, which may include personal data, very carefully. We have taken various technical and organizational measures to protect your personal data against loss or unauthorized use. Our employees and third parties engaged by us are obliged to ensure the confidentiality of your data and to comply with this Policy.
Each IXXI and all images, photos or other uploaded content are protected by your unique email address and password. Without these login credentials other users cannot view the IXXIs made by you or the content stored in them. We therefore advise you to choose your password carefully and not to share it with anyone!
6. Cookies
Cookies are small data files that are sent to and stored on your computer, tablet, smartphone or other device used to access the internet, whenever you visit our Website or use the Creation Module. We use cookies to enhance your user experience when you visit the Website or use the Creation Module or our other services. These cookies ensure that our Website recognizes your browser, preferences and history when you next visit our Website. We can also use cookies to provide you with relevant information, to generate reports on the use made by visitors or users of our services via the Website and the Creation Module, and to facilitate integration with social media networks.
IXXI uses the following types of cookies:
Functionality cookies: these cookies are necessary to allow you to browse our Website and use our services. Functionality cookies facilitate the use of our Website and therefore store your personal settings and items added to your shopping cart and track whether a particular message has already been displayed to prevent the same message from displaying again.
Analytics cookies: these cookies are used to collect data on the use of our Website or the Creation Module via Google Analytics or Hotjar. No personal data are used for this. These statistics show us, for example, how often our Website is visited, which parts of our Website visitors find most interesting, what types of products are viewed and which functionalities of the Creation Module have been used. These data are used for statistical analysis of visitor, usage and clicking behaviour. We analyse these data to continually improve our Website and Creation Module and make them as user-friendly as possible.
Tracking cookies: these cookies are used to track which websites and pages you visit other than our Website to collect data about your browsing behaviour. These data enable us to provide you with ads that are more relevant to you and your interests. They are used, for example, to limit the number of times you see an advertisement and also to measure the effectiveness of our digital advertising campaigns. These cookies are placed by external advertising networks such as Google, Bing, Facebook, Instagram, Marktplaats and Ve Interactive, on behalf of and with the permission of IXXI.
The cookies referred to above are used only by us and the data collected through these cookies are not shared with third parties, except where this is necessary for any of the purposes outlined above and then only in accordance with this Policy. You can delete the cookies placed on your computer by your browser if you want to. Most browsers accept cookies automatically, but you can change your browser settings to block cookies if you no longer want to accept them. More information about this can be found in the “Help” section of your browser. If you disable cookies you can still visit our Website, but some of our services and certain parts of the Website may not function properly.
7. Your rights
The General Data Protection Regulation (“GDPR”) gives you the right to request access to the personal data we hold about you and the right to request us to rectify or complete your personal data if you find them to be inaccurate or if you want them rectified or completed for another reason. The same applies to a request to erase your personal data or to block them if they are inaccurate, incomplete or irrelevant, if they are otherwise processed in violation of the law. You also have the right to restrict our processing of your personal data, to object to the processing of your personal data, to have us delete all of your personal data and to have us transfer these data to you or to another party. You can submit such requests to our customer service by sending an email to mail@ixxi.com. We will inform you of the action taken on your request within one month of receipt of the request. This period may be extended by two further months where necessary, taking into account the complexity and number of the requests. If we turn down your request, you may lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) and seek a judicial remedy.
8. Governing law and disputes
This Policy and your use of our Website and the Creation Module are governed by and construed in accordance with the applicable data protection legislation, including the GDPR and the Dutch Telecommunications Act 1998 (Telecommunicatiewet 1998). Any dispute arising with respect to this Policy and the processing of your personal data can be submitted to the Dutch Data Protection Authority or the courts of your place of residence.

We may review this Policy from time to time. We will post each updated version of this Policy on this page so that you can always know what data we collect, how we use and protect the data we collect and the circumstances under which we disclose and/or provide your data to third parties.
